These Terms & Conditions (“Terms”) govern your access to and use of the website operated by Andria, doing business as The Salt & Serenity (“Company,” “we,” “us,” or “our”), and all photography services provided by Company.

By accessing this website, submitting an inquiry, booking services, signing an agreement, or otherwise engaging with Company, you (“Client,” “User,” or “you”) agree to be legally bound by these Terms.

If you do not agree, do not use this website or engage our services.

1. SERVICES

Company provides professional photography services including but not limited to:

  • Weddings

  • Engagement sessions

  • Family sessions

  • Maternity sessions

  • Portrait sessions

  • Lifestyle photography

Specific services are governed by a separate, signed Photography Services Agreement (“Client Agreement”).

2. INCORPORATION OF CLIENT AGREEMENT

All clients booking services must execute a Photography Services Agreement.

These Terms are incorporated by reference into all signed agreements.
In the event of a conflict, the signed Client Agreement controls.

3. BOOKINGS, PAYMENTS & CHARGEBACK PROTECTION

A non-refundable retainer is required to reserve any session or event date.

Client agrees not to initiate chargebacks or payment disputes for services rendered or retainers paid in accordance with a signed agreement. Any improper chargeback shall constitute a material breach of contract, and Client agrees to reimburse Company for all fees, costs, and attorney’s fees incurred in responding to such dispute.

All fees are non-refundable unless expressly stated in writing.

4. CANCELLATION & RESCHEDULING

Cancellation and rescheduling policies are governed by the signed Client Agreement.

All retainers are non-refundable.

5. FORCE MAJEURE

Company shall not be liable for failure to perform services due to events beyond reasonable control, including but not limited to:

  • Illness

  • Medical emergencies

  • Government restrictions

  • Natural disasters

  • Pandemics

  • Travel disruptions

  • Power outages

6. SUBSTITUTE PHOTOGRAPHER

If Company is unable to personally attend an event due to illness, emergency, or unforeseen circumstances, Company may secure a qualified substitute photographer.

Company retains full responsibility for editing and final delivery. Use of a substitute does not constitute breach and does not entitle Client to refund.

7. HEALTH, SAFETY & ASSUMPTION OF RISK

Participation in photography sessions may involve physical movement, outdoor environments, uneven terrain, and unpredictable elements.

Client assumes all risks associated with participation. For maternity sessions, Client assumes all pregnancy-related risks.

Company is not responsible for injuries, fainting, medical events, or accidents occurring during or after services.

8. CLIENT RESPONSIBILITIES

Client is responsible for:

  • Cooperation during sessions

  • Securing location permissions

  • Ensuring participant safety

  • Preventing guest interference

Company is not responsible for missed images due to lack of cooperation, venue restrictions, lighting conditions, or guest behavior.

9. CHILDREN DISCLAIMER

Company does not guarantee cooperation of children or family members. No refunds or reshoots will be provided due to behavior, mood, or attention span.

10. INTELLECTUAL PROPERTY

All images, content, branding, logos, graphics, and text on this website and created by Company are protected by U.S. copyright law.

Company retains full copyright ownership of all images.

Clients receive a limited, non-commercial license for personal use only.

RAW files are never released.

Unauthorized reproduction, alteration, resale, or distribution is strictly prohibited.

11. DMCA NOTICE

If you believe copyrighted material has been used improperly, please submit written notice to:

Company reserves all rights to pursue legal remedies for copyright infringement.

12. WEBSITE USE

You agree not to:

  • Copy, scrape, reproduce, or redistribute content

  • Use images for commercial purposes

  • Reverse engineer website materials

  • Attempt unauthorized access

Violation may result in legal action.

13. SECOND SHOOTERS & CONTRACTORS

Company may engage independent contractors, including second shooters and associate photographers.

All contractors operate under written agreements assigning full ownership of work to Company. Clients waive claims regarding use of assistants or contractors.

14. PRIVACY & DATA COLLECTION

By submitting inquiries, forms, or payments, you consent to the collection and use of your information for business purposes.

Company may collect:

  • Name

  • Email address

  • Phone number

  • Event details

  • Payment information

Company does not sell personal data.

Users are responsible for ensuring information submitted is accurate.

15. ADA ACCESSIBILITY STATEMENT

Company is committed to making this website accessible to users of all abilities and strives to follow applicable accessibility guidelines.

Company’s total liability for any claim arising out of services or website use shall not exceed the total amount paid by Client.

Company shall not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Company from any claims, damages, losses, or expenses arising from:

  • Your participation in services

  • Breach of these Terms

  • Violation of intellectual property rights

  • Misuse of website content

18. NON-DISPARAGEMENT

Users and Clients agree not to publish false, misleading, or defamatory statements regarding Company, its services, or business practices.

19. DISPUTE RESOLUTION & ARBITRATION

Before initiating litigation, the Parties agree to attempt good-faith mediation.

Any dispute arising out of these Terms or services shall be resolved by binding arbitration in the State of California, except where prohibited by law.

The Parties waive the right to a jury trial.

20. CLASS ACTION WAIVER

You agree that any dispute shall be resolved individually and not as part of any class action, consolidated action, or representative proceeding.

21. GOVERNING LAW

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

22. ELECTRONIC ACCEPTANCE

By using this website or signing agreements electronically, you consent to electronic signatures and communications.

23. SURVIVAL

Provisions relating to intellectual property, limitation of liability, indemnification, dispute resolution, and governing law shall survive termination.

24. SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

25. MODIFICATIONS

Company reserves the right to modify these Terms at any time. Continued use of the website constitutes acceptance of updated Terms.
